I won…and lost today!

Today was the first of four that I know of. My atty was there to "talk" for me. WE were able to get her to provide proof that she got over 18,000 for my son. She was ordered to report this to the support office but she did not until today. They had to credit my account arrears account. They released the order to sequester my benefits to pay this. the total owed is base on me working the years (3 1/2) it took to get through the ssi process. They were not allowed by law to retroactively adjust this amount to reflect my true income of only $123 cash asst. and $140 in food stamps that I managed to survive on for those years. It was not easy but I was able to support myself with it. Many good friends and family helped a lot too.
I have to pay only $25 a month in current support in the new order today. That is great, I could not have dreamed of a better out come:) My Son will still get his $480 a month from ssi as long as I do.  This should give her enough for his support.
I have to figure out where the money owed me from ssi is. I thought that it was in the escrow account at the support office but they said today that they never received any thing from my ssi. I called the ssi office today and they said that it had something to do with a insurance claim in 1993 for a on the job accident that caused me to be out of work to have both knees repaired from the auto accident. I used to deliver flowers for a flower shop. On a delivery one day some guy ran a light and hit my truck almost head on. I was unconscious for about three weeks and then did not remember who I was for another two. I had a lot of broken stuff. The flowerer’s flew from behind me and fractured my skull too. It was a bad few years but I got my self back to about 99%. Back to the topic, I do not know how they could take this money to "repay" the insurance companies for what they paid for me back in 1993. I have to talk to my ssi atty and have him check this one out.
Well did I win or not? I did, but I didn’t, I won to have it all over for the foreseeable future AND I lost because I had to pay over $1,000 to get her to follow her court order to give me the proof I needed. I had my atty ask the judge to make her pay his fee because she disobeyed the order and she did not show up for the last trial where I would have asked her under oath if she got the money and how much. This judge was the same one in that one and remembered her not showing up. She might have been still mad at her a bit. GOOD.
Well I have to start thinking about the next episode in court. It is in 10/14 for the pfa (protection from abuse) thing. Every thing she claimed in her petition is going to be very hard for her to prove true. That will be an easy one to get finished. I hope. I have to take all the new papers I got last week for this pfa and harassment too for my atty to read and get ready for round two.

  1. I am glad something good happen!!! I know how frustrating it gets when dealing with child support. My Dh had back child support and he has been making current and back payments. The child support office here says he owes 3,000.00 more than he actually owes. So last week I had to take proof of payments down to the child support case worker. They were really nice to me, I had my two little ones with me. But everytime Dh calls the child support office they always treat him like a dead beat dad.Thankfully by April of 2006 all back child support will be paid.Hope the rest goes well for you.. Did your ex have to pay for your lawyer fees???~♥~Michele~♥~

  3. Your luck runs about as good as mine. Allie was too sick for me to go into work. I took her to the ER and she has an ear infection, it seems as though our Lord just wants me to be where I am, because that is where I always end up. Keep your chin up and that is all I can say. That is what I do. So far I have heard nothing from Allies dad. He sent an e-mail offering his condolences for my Brother. Like that is heart felt, he just worries what the courts will think of him carrying on the way he did on the day my brother died, of course he really did not know about it then…

  5. Hey there! The war may not be over, but at least you can claim this battle! Although, it seems strange to me that they would make you pay out of your ssi check when he already gets the same amount? But I will admit I don’t know a think about it. Just seems moronic to me. That car wreck sounds terrible! I am sorry you had to go through it, but glad that you seem to have recovered fairly well from it. If you don’t mind my asking, what are you on ssi for?   6. I’ve been reading your blog on and off for a few weeks now. Granted I haven’t had to the time to sort through all the entries pertaining to your ex wife. From where I sit she sounds un-stable and that she is using your son as a pawn. However, I am not sure I understand why you are receiving SS benefits? You once stated you were on disability? Is there no job you can hold? I mean you find time to blog and you must be of reasonable intelligence to find an office job. Believe me I am not saying she should receive any money from you from support. At times I am not sure either one of you would be in the best interest of the child. It is obvious you love him, and I can’t believe you would ever harm him. I also know from experience that a woman can claim abuse and the court believe her when she is the one who started it. There just seems to be so much drama and if you are really the stable person you claim to be I would hope you have an attorney who can prove this in court and prove her to be un-stable so you can have full custody. Obvioulsy this child does not need to be used as a pawn by her for money any longer. I kept my e-mail private as I didn’t want a vast amount of hate e-mails coming my way from your site. You have many supporters. Even though I support you in getting your son away from her there are many questions that are unanswered her as to why the court didn’t give you more time etc. If you would like to e-mail me on this subject I would love to go in more detail about my experiences I have a brother in law who is going through a lot of the same crap you are.
